Tax declaration for residents

23.10.2007

It's a fact that everyone who is a resident of Spain has to declate their complete income here. There is a serious misconception among man resident ex-pats that they only have to declare their Spanish income here. Many also falsely believe that they don't even have to complete a formal tax declaration, and simply have to wait for the tax bill to arrive.

It is important to clarify a couple of matters: the duty of declaration and payment of taxes in Spain, without exception, lies with the resident. This means that they must, without prompting, complete and subit a full tax declaration. Not doing this risks incuring significant financial penalties, and in the case of a property sale, may even be treated as a non-resident. The latter means that the sale of any property must be accompanied by a certificate from the Spanish tax authority, which certifies that all Spanish tax requirements have been fulfiled before the property can be sold.

Again, if this document can not be produced, he or she will again be treated as a non-resident.
